Gender Identity policies

UCU is aware that some institutions are proposing to replace existing policies the make provision for gender identity with new ones based on the EHRC draft statutory code of practice following the Supreme Court ruling in April 2025.

UCU has urged caution around any changes as UCU also believes there will be tests of the ruling in court. It is not clear how the rule will effectively work out in practice particularly with regard to interaction with gender reassignment regulations in the Equality Act 2010 and in relation to the Gender Recognition Act 2004.

UCU branch guidance following the Supreme Court ruling can be seen by viewing this link

UCU is in the process of enacting policy by producing guidance about how policies and practices can both recognise the Supreme Court ruling and be inclusive of trans and non-binary staff and learners in relation to laws that protect on the grounds of gender reassignment.

UCU wishes to keep a national view on what is happening in addition to regional UCU support for branches challenging policy and practice in the usual way. If your branch, or UCU staff in regions and nations, are aware of institutions that have proposed changes please complete this form
